The right to defend one’s lawful interests in a fair court and the right to the assistance of an advocate are some of the basic human rights established in Section 92 of the Constitution of the Republic of Latvia.

Individuals are also provided with these rights in accordance with the Criminal Procedure Law, which states that every person presumed or alleged to have committed a criminal offence has the right to a defence, i.e. to know the crime, of which they are suspected, or with which they are charged, and to choose the position in their defence.
