The client owned a real property located in a protected natural zone, and did not have its own access road, and the access road that did exist at that point crossed a number of other adjacent real properties.
Solution
Through negotiations, an agreement for establishing a road easement was achieved with some of the real property owners; however, others did not agree to the road easement using the procedure specified in Section 1231, Paragraph 3 of the Civil Law, which resulted in a lawsuit for the establishment of a road easement.
A decision for the non-application of the environmental impact assessment procedure was obtained from the Environment State Bureau.
A court ruling established an easement for a road leading to the plaintiff’s real property within the land of adjacent real properties, setting the scope of the road easement based on the draft plan for the road easement submitted as part of the lawsuit.
