So far the public and private partnership has not seen much use in Latvia; however, in additional to the theoretical knowledge of the topic, the firm’s representatives had practical experience in handling the matters associated with it. On 31 July 2018, a concession award procedure was announced, as part of which the private partner for the public and private partnership to manage household waste in Riga was to be selected. The project was to fully achieve the goals of Directive 2008/98/EC of the European Parliament and of the Council, namely, to improve access to the waste collection service (in particular, the separate collection of waste), to inform and to educate with the purpose of building environmental awareness and encourage participation in the sorting of waste, to increase the waste recycling capacity and to implement new methods of recycling waste.
Solution
The leading partner of the firm provided legal assistance arranging the ‘Selection of the private partner for the management of household waste in Riga’ concession award procedure, and represented the interests of the firm’s clients (Riga City Council and SIA Getliņi EKO, as the commissioning party in that particular concession award procedure) in the administrative procedure body (Competition Council) and in the Administrative Court. Based on a decision of the Competition Council, the fulfilment of the concession agreement concluded after the concession award procedure was suspended; however, no final ruling has been made in the case concerning the future fulfilment of the concession agreement.
